Yes, I can agree that some kind of marking is required to understand the file
correct (like for any other encoding), but does it have to be a BOM? Or can
it be some other marking, like the one used in XML files?

I'm no expert on unicode (actually knows very little) so I looked at the
unicode site <http://www.unicode.org/faq/utf_bom.html> and from what I can
see there is nothing the requires BOM although it's suggested that it's used
when UTF-8 is used in text files.
